Terms of Service

Please read these Terms of Service ("Terms") carefully before using any AI Growth Z products or services. By installing, activating, or using any AI Growth Z extension or purchasing a license, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User," "you") and AI Growth Z ("we," "us," "our"), operated by Jay Hernandez, a sole proprietor based in the United States. These Terms apply to all AI Growth Z products including, but not limited to, Reachify Z and Growify Z (collectively, "the Services").

By purchasing a license, installing an extension, or using any feature of the Services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Services

AI Growth Z provides browser-based productivity tools ("Extensions") designed to assist users with social media outreach and growth activities. Our current Extensions include:

• Reachify Z — An AI-powered outreach assistant for discovering prospects and sending personalized messages on Instagram.
• Growify Z — An engagement assistant for automating interactions such as liking posts on Instagram.

The Services are provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any feature at any time without notice.

3. Third-Party Platforms & Account Risk

Our Extensions interact with third-party platforms, including Instagram (owned by Meta Platforms, Inc.). AI Growth Z is not affiliated with, endorsed by, or partnered with Instagram, Meta, or any other third-party platform. These platforms maintain their own Terms of Service, which you are solely responsible for reviewing and complying with.

You acknowledge and agree that the use of automation tools on third-party platforms carries inherent risk, including the possibility of account warnings, temporary restrictions, or permanent suspension by those platforms. AI Growth Z is not liable for any disciplinary action taken against your account by any third-party platform, including Instagram, regardless of the circumstances.

To minimize risk, we provide recommended safe usage limits within our Extensions. If you use the Extensions within these recommended limits and do not engage in abusive behavior, you reduce (but do not eliminate) the risk of platform action. We make no guarantee that usage within recommended limits will prevent account restrictions, as third-party platforms change their policies and enforcement practices independently of us.

4. User Responsibilities & Acceptable Use

By using the Services, you agree to the following:

• You will use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
• You will not use the Services to spam, harass, threaten, or engage in any abusive conduct toward other users on any platform.
• You will not exceed the recommended safe usage limits provided within the Extensions or deliberately circumvent built-in safety features.
• You will not use the Services to send unsolicited bulk messages, phishing content, or any form of deceptive communication.
• You are solely responsible for the content of any messages sent through the Services and for any consequences arising from that content.
• You will maintain the security of your own social media accounts and API keys.

5. License Keys & Access

Upon purchasing a subscription, you are granted a single, non-transferable, non-exclusive license to use the applicable Extension on one device and one account at a time. License keys are issued per individual user.

You may not share, sell, transfer, sublicense, or otherwise distribute your license key to any other person.

We actively monitor license usage patterns. We reserve the right to immediately revoke or suspend your license, without refund, if we detect any of the following:

• A single license key being used simultaneously on multiple devices.
• A single license key being used from multiple geographic regions or IP addresses in a pattern inconsistent with individual personal use.
• Evidence of key sharing, reselling, or distribution to third parties.
• Any attempt to reverse-engineer, modify, or bypass the license verification system.

Revocation under these circumstances is permanent and does not entitle the user to any refund or credit.

6. Payments & Billing

Access to premium features of the Services requires a paid subscription. All prices are displayed in USD and are subject to change with reasonable notice.

Subscriptions are billed on a recurring basis (monthly or annually, depending on your plan) through our payment processor. By subscribing, you authorize us to charge your payment method at the start of each billing period until you cancel.

You may cancel your subscription at any time through your account dashboard or by contacting support@aigrowthz.com. Cancellation takes effect at the end of the current billing period. You will retain access to paid features through the end of the period for which you have already been charged.

7. No Refund Policy

All sales are final. AI Growth Z does not offer refunds, credits, or exchanges under any circumstances. This includes, but is not limited to:

• Unused portions of a subscription period.
• Purchases made in error.
• Dissatisfaction with results or outcomes of using the Services.
• Account restrictions or bans imposed by third-party platforms.
• Service interruptions, feature changes, or discontinuation of the Services.
• License revocation due to violation of these Terms.

By completing a purchase, you expressly acknowledge and agree to this no-refund policy. If you initiate an unauthorized chargeback or payment dispute, we reserve the right to permanently ban your account and pursue recovery of any associated fees.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AI Growth Z, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, loss of goodwill, loss of social media accounts, or any other intangible losses, arising out of or related to your use of or inability to use the Services.

In no event shall our total cumulative liability to you for any claims arising from or related to these Terms or the Services exceed the total amount you paid to AI Growth Z in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific results from use of the Services, including but not limited to follower growth, engagement increases, or message response rates.

10. Indemnification

You agree to indemnify, defend, and hold harmless AI Growth Z and its owner, officers, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including any Instagram or Meta policies; or (d) any content or messages sent by you through the Services.

11. Intellectual Property

All software, code, designs, trademarks, and content associated with the Services are the exclusive property of AI Growth Z. You are granted a limited license to use the Extensions for their intended purpose only. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from any part of the Services without our express written permission.

12. Termination & Suspension

We reserve the right to suspend or permanently terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent activity, abusive behavior, or at our sole discretion. Upon termination, your license to use the Services is immediately revoked. No refund will be issued upon termination for cause.

13. Geographic Availability

The Services are operated from the United States. We make no representation that the Services are appropriate or available for use in all locations. If you access the Services from outside the United States, you do so at your own initiative and are responsible for compliance with local laws and regulations. We reserve the right to restrict access to the Services from certain countries or regions at our discretion.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class-action lawsuit or class-wide arbitration against AI Growth Z.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
